1. Definitions

• "We" / "Us" / "Unique Creativity" — the seller and e-commerce entity described above.
• "You" / "Customer" / "User" — any person who visits the website or places an order.
• "Products" — the custom-made goods offered for sale on the website.

2. Eligibility

You represent that you are at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872. Persons who are minors, un-discharged insolvents or otherwise legally barred from contracting may not transact on this website. If you transact on behalf of a business, you represent that you are authorised to bind that business.

3. Orders & Customization

• All Products are made to order based on the design, text and specifications you provide.
• You are solely responsible for ensuring that the design, spelling, size, colour and all other details are correct and approved by you before confirming the order. We produce exactly as per your approved specifications.
• Once production has started, modifications may not be possible. Please contact us immediately after ordering; we will try to accommodate changes if production has not begun. Additional costs from post-confirmation changes are borne by you.
• An order constitutes an offer to purchase; a binding contract is formed only when we accept and confirm the order. We reserve the right to accept or decline any order.
• We may refuse or cancel any order containing content that is offensive, unlawful, deceptive, or that infringes third-party intellectual-property or other rights.

4. Pricing & Payment

• Prices are displayed on the website in Indian Rupees (₹) and are subject to applicable GST and shipping charges shown at checkout. Prices may change without prior notice, but confirmed orders are honoured at the agreed price.
• An advance payment of 50%–100% of the order value is required to initiate customization, and is non-refundable given the personalised nature of the Products.
• Payments are processed through our RBI-authorised payment gateway partner (Razorpay) and other methods we specify. We do not store your card, UPI or bank credentials.
• In the event of a failed transaction where money is debited without an order confirmation, the amount is typically auto-reversed by your bank/gateway; contact us with proof if it is not.

5. Production, Shipping & Delivery

Production timelines depend on order size and complexity; estimated dispatch/delivery dates are provided at order confirmation and are indicative. Shipping charges and delivery times depend on destination, weight and the selected shipping method. We are not liable for delays or failures caused by events beyond our reasonable control, including:

• Courier or logistics disruptions
• Natural disasters or extreme weather
• Strikes, political events or civil disturbances
• Incorrect or incomplete address provided by you

If a Product is damaged in transit, notify us with clear photographs within 48 hours of delivery; verified claims are handled per our Refund Policy. Minor variations in colour, size or texture inherent to the production process are not defects.

6. Cancellation, Returns & Refunds

As all Products are custom-made, cancellations, returns, exchanges and refunds are governed by our Cancellation, Return & Refund Policy, which forms part of these Terms. In summary: the advance is non-refundable; defective, incorrect or transit-damaged items must be reported within 48 hours of delivery with photo/video proof; and approved refunds/replacements are processed within 7–10 business days.

7. Intellectual Property

• You confirm that you hold all necessary rights, licences and permissions for any logos, images, artwork, names or text you submit, and that they do not infringe any third-party copyright, trademark or other rights. You indemnify us against claims arising from content you supply.
• We may refuse any design that is unlawful, infringing, offensive or inappropriate.
• All content, designs, graphics, logos and material created by Unique Creativity, and the website itself, are our intellectual property and may not be copied or reused without permission. Designs we create for you may be used for our portfolio/promotion unless you request otherwise in writing.

8. Acceptable Use

You agree not to use the website for any unlawful purpose, not to upload harmful, infringing, obscene or misleading content, not to attempt to breach its security, and to comply with Rule 3 of the Information Technology (Intermediary Guidelines) Rules and all applicable laws.

9. Product Safety & Warnings

• Products are made with quality materials and undergo quality checks; please handle them with care.
• Some Products contain small parts, pins or sharp edges and are not suitable for children under 5 years. Adult supervision is strongly advised.
• We are not liable for damage from misuse, improper handling, moisture or extreme temperatures after delivery, or for injuries resulting from improper use.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from the use of our website or Products. Our total aggregate liability for any claim shall not exceed the value of the specific Product giving rise to the claim. Nothing in these Terms limits any statutory rights you have as a consumer under the Consumer Protection Act, 2019.

11. Indemnity

You agree to indemnify and hold harmless Unique Creativity from any claims, damages, losses or expenses arising out of your breach of these Terms, your misuse of the website, or content/designs you submit.

12. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, government action, strikes, power or internet failures, or supply-chain disruptions.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy, which is compliant with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000, and forms part of these Terms.

14. Grievance Redressal

In compliance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, any grievance regarding an order, the website or these Terms may be addressed to our Grievance Officer. Complaints are acknowledged within 48 hours and endeavoured to be resolved within one (1) month.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable consumer-protection laws, the courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the website.

16. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. Continued use of the website after changes constitutes acceptance of the updated Terms.
